I’d start with securing the unequivocal assets. Protect them from repossession. Make lists, find receipts, etc. If there’s no receipt, and if you’ve been married for thirty years, then most everything will be considered shared assets.

The municipality has an officer for financial advice; contact them and ask if they can help you with advice and info about the legalities if you can’t afford a solicitor. They will certainly know what the Enforcement Office can take and what they can’t take.

Grimly put, your property rights are secondary to the expediency of the Enforcement Office here. I’m sure the EU would have objections to this, but nobody has tested this expediency precedent most officials in Sweden follow. I’d be interested in how the CJEU would treat this expediency against the treaty obligations and the ECHR property rights protections.

You are right about it being some really bad financial decisions that I had no idea about. Självklart. Utmätning förekommer i alla unionsländer. Däremot, av de 33 tillfällen som Sverige har stridit i Europadomstolen, så har det aldrig prövats om KFM har rätt att, som tidigare nämnts, ni får utmäta tredje mans egendom. Äganderätten är central, och huruvida åsidosättande av äganderätten gör KFMs jobb smidigare är nog ganska långt nere på deras prioriteringslista. Men, förstås, jag kan ju ha fel, det har ju hänt förr - så om någon har målnummer för fallet där Europadomstolen har beslutat att "KFM får ta den utlånade bilen för att betala tredje parts skulder" så ska jag korrigera min bedömning.

Europadomstolen brukar annars vara ganska pigga på att hävda att i mål mellan en stat och en individ så är det staten som har den fulla bevisbördan. Något som är av central betydelse i grundfördragen för både Europarådet och Unionstraktaten. Som en institution som, grovt sett, baseras på "civil law" snarare än "common law" så brukar inte Europadomstolen läsa in "om man kisar och håller pappret uppochner så kan man utläsa vad lagstiftaren egentligen menade med den här luddiga lagen". Och ECHR och fördragen är allt annat än luddiga här.
